Understand What the Insurance Company Is Disputing
An insurer may question who caused an accident, whether a policy covers the claim, or how much your injuries have cost you. Those are different disputes, and each calls for a different response.
Collier & Collier represents injured people seeking compensation. We can review the insurer’s explanation, the available evidence, and an offer you have received. A denial is the insurance company’s position. Whether it can be challenged depends on the facts, the policy, and the law.

Help With Denied, Delayed, or Undervalued Injury Claims
How We Help Pursue the Claim
If we represent you, we gather available evidence of responsibility and loss, communicate with the insurer, and explain settlement options. When an offer leaves out a supported loss, the response should show what is missing and why it matters.
If the claim cannot be resolved through negotiation, we assess the legal action available. Depending on the dispute, a lawsuit may concern the person who caused the injury, obligations under an insurance policy, or both. Contacting an insurer is not the same as filing a lawsuit against the proper parties.
For information about the underlying accident, see our Vehicle Accident Injuries and Premises Liability pages. The cause of the injury and the insurance dispute are parts of the same case, even when they raise different questions.
Before Signing a Release
A settlement release can close claims covered by its terms, including claims for losses that become clearer later. Have the offer and release reviewed together, especially if treatment is ongoing or the long-term effects are uncertain.
Keep letters, emails, and any settlement documents you receive. Ask about requests for recorded statements or broad medical authorizations before responding, while continuing to meet applicable policy duties and deadlines. Do not simply ignore your insurer’s requests.

Do Not Let Negotiations Replace a Deadline Review
Virginia personal-injury lawsuits generally have a two-year filing period, subject to exceptions and rules about when the claim begins. Insurance-policy claims can involve different deadlines and notice requirements.
Continuing to negotiate does not, by itself, preserve the right to sue. Have the applicable deadlines checked even if an adjuster is still reviewing your records.
A Richmond Firm on Your Side of the Claim
Collier & Collier is a family-operated personal injury firm serving Richmond and nearby communities. We offer a free case review to discuss the injury, the insurer’s response, and whether we can help.
Attorney fees are payable only if the case settles or is won. Case expenses are separate and should be explained in the written fee agreement.
