Get Answers About an Injury or Change in Care
A fall, an unexplained injury, or unanswered concerns about care can leave a family unsure what happened. Collier & Collier can discuss whether abuse or neglect may have harmed your loved one and whether a legal claim is worth investigating.
You do not need to prove the case before contacting us. At the same time, an injury or decline in health does not by itself establish wrongdoing. The resident’s condition, care needs, records, and the facility’s response help determine whether the care provided fell short and caused harm.
If your loved one is in immediate danger or needs emergency medical help, call 911. Do not wait for a legal consultation.

Abuse and Neglect Can Raise Different Questions
Abuse can involve harmful treatment such as physical mistreatment, threats, or improper restraint. Neglect concerns a failure to provide needed care or protection. A legal review may examine:
- Whether staff followed the resident’s care plan and responded to changes in condition.
- Whether needed assistance with eating, drinking, hygiene, or movement was provided.
- Whether fall risks were assessed and appropriate precautions were taken.
- Whether skin injuries or other medical concerns received an appropriate response.
- Whether reports of mistreatment were addressed and the resident protected.
These are issues to investigate, not proof that every fall, pressure injury, or medical complication resulted from negligence. Medical evidence may be needed to distinguish an unavoidable problem from harm caused by inadequate care.
How a Legal Claim Is Investigated
If we take the case, the investigation can involve medical and facility records, care plans, incident reports, photographs, and accounts from people who observed the resident’s care. The goal is to understand what care was required, what was provided, and how any failure affected your loved one.
Virginia law treats many nursing-home care claims as medical-malpractice claims. That can affect the evidence needed, the filing rules, and legal limits on recovery. Calling an incident “neglect” does not determine which rules apply.
An attorney also needs to identify the proper parties and who has authority to act for the resident. Being a concerned relative does not automatically give someone authority to bring or settle the resident’s claim.e.
What Compensation May Address
When abuse or negligent care causes injury, a claim may seek compensation for resulting medical expenses, physical pain, mental anguish, and other supported effects on the resident’s health and daily life. Future care needs may also matter when the evidence connects them to the harm.
Pre-existing illness does not make an injury unimportant. The case must distinguish the resident’s underlying condition from additional harm caused by the conduct at issue. An attorney can assess that distinction and any applicable limits on damages.
If the harm contributed to a death, different rules govern the claim and who may bring it. Our Wrongful Death page explains that area of representation.
Reporting a Concern and Pursuing a Claim
The Virginia Department of Health’s Office of Licensure and Certification receives complaints about nursing homes. Assisted living facilities have a different oversight route through the Virginia Department of Social Services. The facility type matters when choosing where to report a concern.
A regulatory complaint can prompt an investigation into care standards. A civil claim seeks a legal remedy for the resident’s harm. Reporting to an agency does not take the place of having lawsuit deadlines reviewed.
Keep the correspondence and photographs you already have, and note when you raised concerns and what you were told. Do not delay needed medical care or wait to assemble a complete file before asking for help.
